Control over operations with timber

The Inspectorate of the Ministry of Taxes and Duties of the Republic of Belarus in Minsk region, within the framework of the control and analytical work carried out for business entities engaged in logging and wholesale trade in sawn timber, drew attention to the activities of some of them, and, as it turned out, it was not unreasonable.

Based on the results of the work carried out, cases of sale by business entities of sawn timber without documents confirming their purchase and receipt were established. It was established that, according to the waybills, waybills, the sale of products was carried out that had not been previously purchased by these sellers, payment for which had not been made.

As a result, against the sellers of sawn timber, a protocol was drawn up on an administrative offense under Article 13.12 of the Code of Administrative Offenses of the Republic of Belarus (9 hereinafter referred to as the Code of Administrative Offenses) and sent to the Economic Court.

By the decision of the economic court, the violator was brought to administrative responsibility in the form of a fine in the amount of 30 percent of the value of the subject of the administrative offense, which in monetary terms is more than 218.0 thousand rubles.

At present, the economic court has been sent reports on an administrative offense for similar violations committed by other business entities engaged in the timber trade.

Please note that as a result of the work carried out, questions arise for all participants in the transactions, including the buyers of the products, namely, was it actually acquired and from whom? Will history repeat itself with the prosecution under Article 13.12 of the Administrative Code and with them?

The verification materials will be sent to the competent authorities for a legal assessment.
